The Bombay High Court clarified that the rights of tenants in houses are limited and do not exceed the rights of the owners. It has been said that even if the owner wants to repair his house, the tenants cannot prevent it. It concluded that, although tenants have certain rights, they are limited. A tenant is staying in a house in Worli, Mumbai. In this order, the owner of that house wanted to repair it. For that, they wanted the tenant to shift houses so they could repair the house. After the work was completed, they wanted to give the house to that tenant again. However, the tenant argued that they could carry out the repairs without vacating the house. To this extent, permission was also obtained from the Mumbai Civic Chief. This was challenged in the High Court by the owner of the house. The bench that heard it held that the rights of tenants are limited.
