Centre promises SC.. uniform realtor-buyer agreement

The Supreme Court has responded on the PIL, filed by Ashwini Upadhyay, seeking to protect home buyers from exploitation by the real estate developers. The petitioner urged the apex court for directions to the Centre for preparing uniform model builder-buyer agreement and agent-buyer agreement. The issue came up before the SC Bench comprising justices DY Chandrachud and HimaKohli on Thursday. The Centre told the Bench that a uniform builder-buyer and agent-buyer agreements applicable for the whole country would be prepared in tune with the RERA Act of 2016.

The SC recorded the road map prepared by the Additional Solicitor-General Aishwarya Bhati, Amicus Curie Devasish Barucha in this regard. According to it, the Centre in association with the Amicus Curie will prepare a model agreement – Part A will be in tune with the mandatory rules of the Real Estate (Regulation and Development) Act 2016. No state or UT would be able to amend these rules framed to safeguard the interests of the home buyers. The agreement should be part of all sale agreements without fail, the SC ruled.
