SC Bench directs Center to prepare Model builder-buyer agreement

The Supreme Court reiterated that the builder-buyer model agreement is essential to protect the interests of the middle class homebuyers. It directed RERAs to prepare the guidelines on how the model builder-buyer agreement should take shape. Instead of leaving the matter to states, the Center should evolve a policy for uniform implementation across the nation, the Bench felt.

A SC Bench comprising Justices DY Chandrachud and Chandrakant issued necessary directions. The Bench heard a petition filed by advocate Aswini Upadhyaya, who laid emphasis on the model agreement to protect interests of the buyers, praying the Bench for directions to the Center.

The petitioner felt that the model agreements prevalent in the states are being affected by builders and terms and conditions in the agreement vary from state to state. Therefore, Aswini prayed for directions to implement a uniform model agreement in the country. Earlier, the apex court heard a similar petition and asked the Center to communicate its stand on it. In a fresh direction, the Bench issued several crucial directions to the government.

Terming the model builder-buyer agreement as a very important aspect, the Bench suggested the Central Advisory Council to evolve suitable guidelines. “The Bench is very clear about it. The Centre should evolve the policy guidelines instead of leaving it to the states to implement a uniform agreement in the country,” the Bench remarked.
