There is no doubt that Hyderabad city has gained international fame due to the revolutionary decisions of the State government. As a result, the land prices have also increased. Flat rates are skyrocketing. While some developers struggle to grow at such a time, companies like EIPL are accustomed to buying disputed lands and announcing pre-launch sales. EIPL has collected crores of rupees from buyers, in the name of pre-launches. As the directors of the company filed cases against each other following internal different over profit sharing. Later, they got separated and started running their own businesses. But the company is back in news after the court directed the police to file an FIR against EIPL Constructions partner Kondapalli Sreedhar Reddy and others, in connection with a land in Maheswaram. What are the details of this case and pre-launch offer by EIPL? Here is our findings.

 

Pre-launch sales of flats and villas appear to have generated crores of rupees for EIPL which seems to be under the impression if they spend money, any illegal act will become legal, and they are under the delusion that whatever they do in the society is valid. Because, despite knowing that it is a government land and there are many court disputes pending on it, the company tried to procure the land illegally by bribing the authorities concerned. Apart from these 42 acres, it made a huge plan to occupy more than a 100 acres right next to it. But the plan got busted.

Pre Launch Villa Project in Trouble?

EPIL proposed to build premium high-end villas on 150 acres in Nagaram, about 5 km from Exit 15 of the Outer Ring Road near Shamshabad Airport. A pre-launch scheme was announced promising that those who buy an acre land at Rs 4.5 crores, will get a luxury villa of 7,000 sq.ft built on 1,200 sq.yards land. Buyers were promised that all the approvals will come in six to eight months. The company advertised that by the time the project is announced, the cost would be Rs 9 crore. Buyers were informed that the full amount should be paid within 60 days of booking. Depending on the size of the villa, additional charges were made applicable. Some investors who believed in this company, which has already developed projects in areas like Mokila, Manchirevula and Gandipet, bought villas for Rs 4.5 crore each. And, since the case was registered against EIPL Sreedhar Reddy along with MRO who did the mutation, the project is now in trouble. Many people came to know about this illegal transaction after the case was registered.

A glance at this whole affair, one can easily make out how EIPL tried to misuse the disputed land for its gains. The company has announced that it will build a premium villa community on 150 acres and went ahead with confidence to get all legal issues sorted, despite knowing that the land was disputed. They collected crores of rupees from people. Now, the court ordered to register a case against EIPL company partner Kondapalli Sreedhar Reddy, MRO who mutated the land and some others, the fate of those who purchased villas in the project remains uncertain. The issue is unlikely to get resolved anytime soon, considering its complexity.

Nawab Haji Khan has 92 acres in Survey No. 181 and 10.20 acres in Survey No. 182 at Maheswaram. About 50 acres of 92 acres in Survey number 181 have been recorded as Bhudan lands. The remaining 42 acres of land was illegally registered to EIPL. In 2021, this entire land was registered in the name of Qadarunnisa in Dharani website. But did all this happen without the knowledge of the then District Collector? When she applied to MRO that she was the legal heir of Haji Khan and the succession should be done in her name, MRO and the then District Collector gave consent. The authorities even allowed recording it on Dharani portal and issued pass books. She sold the land to Bobbili Vishwanath Reddy and Santosh Kumar, from whom EIPL purchased it.

Land history

Actually, Haji Khan had two sons and four daughters. One of the daughters is this Qadarunnisa. It is clear that the other five successors are also entitled for a share in this entire land. However, she declared herself as the heir to this entire land. Without ascertaining her claims, both the MRO and the then Collector recorded the land succession in her name.

In fact, in 1970, the entire 92 acres in Survey No. 181 and 10.20 acres in Survey No. 182 was declared under the land ceiling by Haji Khan. He gave 57 acres to his elder son Akbar Ali Khan and 46 acres to his younger son Farooq Ali Khan. Later he said that he was gifting it to his two sons through word of mouth. The same was recorded in the Land Reforms Tribunal Order of 1977. The MRO would have easily ascertained the land ownership, only if he had seen the order copy.

However, Qadarunnisa informed that her father gave her a gift (Hiba) of 52.20 acres (42 acres in Survey No. 181, 10.20 acres in Survey No. 182) in 2005. Incidentally, she sold 10.20 acres to Bobbili Damodar Reddy and others in 2018. She managed to influence the then local MRO and sold the land. Similarly, in 2021, 42 acres of survey no. 181, with the cooperation of the then MRO and the then District Collector, was uploaded on the Dharani portal in her name and later sold to EIPL through Bobbili Vishwanath Reddy and Santosh Kumar. Sources said EIPL has borne the entire cost of this amount. As the court ordered to register an FIR against the EIPL, the fate of the buyers now remains uncertain.
