Builders responsible for accidents

Legal experts make it clear that builders as well as the contractor will be held responsible for accidents that occur during construction work. There is no doubt that both have a responsibility to take appropriate precautions to protect workers at construction sites. Workers lose their lives in occasional accidents during construction work. Although the police arrested the contractors in this connection, they were later released on bail. But the deceased’s family takes to the road. They will not even be in a position to compensate.

Similar incidents continue to occur across the country every year. Workers are losing their lives due to the negligence of contractors and builders but there is no proper action against them. Usually large builders outsource their construction work to a contracting company. If there is an accident on the site and someone dies .. they avoid that it is not their responsibility, it is the responsibility of the contracting company. Several legal experts have responded to this in the background.

The regulations make it clear that it is the responsibility of the contractor as well as the builder to provide workers with safety equipment such as helmets and nets in the workplace. ‘In such cases, criminal as well as civil action should be taken. The police should register a case against the contractor as well as the builder for non-compliance with safety standards.

YP Singh, a senior IPS officer, lawyer and social worker from Mumbai, said that town planning engineers should also be asked to check from time to time whether safety measures have been taken at construction sites. According to the Workers’ Compensation Act 1923, the Janata Bima policy should also be taken out when obtaining a building permit. ‘If there is an insurance policy, the compensation will be paid by that company. If there is no insurance policy, the building permit must be revoked. Work should resume only after the builder pays the appropriate compensation.’
