The Supreme Court has made it clear to 11 states, including West Bengal and UP, to reply to it on the problems in enforcement of RERA in four weeks. Otherwise, Housing Principal Secretaries would have to appear before the court and explain the court the causes for the delay, it warned the government. The apex court bench comprising Justices DY Chandrachud and Justice Hima Kohli asked the principal secretaries housing of all government departments of all states and union territories to clarify on the issues raised by the Centre on the implementation of the RERA-2016. The SC issued the directions responding to a petition filed by petitioner Aswini Upadhyay to ensure greater
transparency in realty sector, reducing the scope for fraud, formulating the model agent-buyer agreement.
The SC directed all states and union territories in March this year to furnish information on RERA. But, only five states responded to the direction so far. Meanwhile, the model agreement has been submitted to the SC by the additional solicitor general Aishwarya Bhati and amicus curie Devasish Bharuka. The part-A of the draft include various safeguards for the buyers, while the part-B of the agreement contained rules applicable to states and union territories. The court posted further hearing in the case to November 28.
