Aditya Construction Company asked to return Rs 2 lakh to buyer with 9% interest
The State Consumer Redressal Commission, Telangana, has asked the realtor Aditya Construction Company to return the amount paid by a consumer – Rs 2 lakh – along with 9% interest as the commission found the condition imposed by the realtor to book the flat or to return the money is unjustified. K Chandrasekhar Reddy of Begumpet area booked a flat in Aditya Silicon Heights in Tellapur during a pre-launch offer of the project by paying Rs 2 lakh.
Later, he asked the realtor to register the flat in the name of his son Naveen Kumar. But, the company refused to comply with the request. It objected to register the flat in the name of Naveen Kumar as the project was booked in the name of Chandrasekhar Reddy. To register it in the name of his son, the realtor demanded payment of Rs 5 lakh. If he did not agree to it, the flat booking would be cancelled.
Then, Chandrasekhar Reddy sought the company to return Rs 2 lakh paid by him, but the realtor refused to return the money. He approached the District Consumer Forum to get back the money. It ruled that the builder should return the amount with 9 per cent interest. The Aditya Construction Company went in appeal to the SCDRC against the decision of the consumer forum. The SCDRC has upheld the decision of the forum.
