Projects launched prior to 2017 to come under RERA purview

Giving a big relief to home buyers in Tamil Nadu, the RERA, Chennai took a crucial decision to resolve the representations from customers of realty projects launched prior to the RERA coming into effect.

The RERA Act in Tamil Nadu came into force in 2017. However, it resolved a complaint pertaining to the project launched prior to 2017 and issued orders. RERA official Saravanan said that the RERA took the decision enforcing the Section 3 of the Act.

Two customers of Amar Prakash Developers Private Limited have complained against the builder with the RERA. The developer promised to hand over the flats in Temple Waves project, launched on Chennai outskirts, before November 2015.

The buyers paid Rs 40 lakh each to buy two flats in the project, but the developer failed to honour the deadlines and postponed handing over of the project by 2017. But the realtor held a bipartite meeting with the customers to finally hand over the flats towards the end of 2018.

But, there are many lacunae in the flats. Therefore, the customers have lodged a complaint with the RERA. The RERA went into their complaint thoroughly and decided to resolve all complaints pertaining to projects launched prior to 2017.

KTR’s assurance to customers

At the time of launching the Telangana RERA office, Municipal Administration Minister KT Rama Rao made a statement to the effect that all projects built prior to 2017 also come under the purview of the RERA. He assured the customers to resolve the problems in the projects launched prior to 2017.

He said that a decision would be taken after studying the problem from all perspectives. The buyers of properties say that RERA has failed to resolve the problems pertaining to new projects and let alone it resolving the problems of customers pertaining to the old projects.
