The RERA Act, passed to protect the interests of the home buyers, is going to be implemented more effectively in view of the recent Supreme Court directions. The RERA rules vary from state to state. The Supreme Court heard a petition on different rules for different states. It directed the Centre to go through the regulations and submit the apex court a report on whether the rules are effective in safeguarding the interests of consumers or not.
The Centre should study whether there are any deviations in the rules framed by the Centre in 2016 and the rules being implemented by states and submit a comprehensive report in the first week of May. A SC Bench comprising of Justice DY Chandrachud and Justice Surya Kant issued orders in this regard. The Forum for People’s Collective Efforts (FPCE) Chairman Abhay Kumar Upadhay, responding on the apex court decision, expressed the concern over the RERA Act failing to meet the set objectives in spite of passing the law five years ago. He attributed it to the states have framed their own rules. Therefore, the SC Bench directions will help more effective enforcement of the legislation, he felt.
