The Consumer Disputes’ Redressal Commission has fined ICICI Bank for misplacing original property documents of a couple. The bank was ordered to pay the couple Rs.55,000 as compensation. According to details, Himanshi Ben and Chaitanya Soni from Jodhpur area have a house in Umiya Vijay Society. The original sale deed and other documents related to the house were pledged to the bank at the time of taking the loan in February 2005. When demanded by the couple, the bank officials are not returning the documents. In fact, they were stolen from the bank’s lawyer’s office in April 2005. However, the bank officials concealed the matter. As the husband and wife were making several rounds to the bank seeking custody of their documents, the bank officials finally revealed the truth to them in 2014. The couple lodged a complaint with the police. Later, they lodged a complaint was filed against the bank in Ahmedabad Consumer Disputes’ Redressal Commission.
They claimed that they not only lost their property documents but also the bank hid the matter from it. Hearing both sides, the commission found fault with the bank. It said it is the duty of the bank to secure the documents of the mortgaged property and as such there is no excuse for not giving those documents for 11 years.
The Commission asked the bank to return the documents to the party in eight days or execute a new sales deed and get it registered and give it to the party in month. Apart from it, the bank has been asked to pay a compensation of Rs.55,000 to the couple.
