The Telangana High court severely assailed a developer who had closed down a road in the name of constructing a gated community, posing problems to people in commuting to other layouts. The court noted that the construction of the gated community is not approved by the local body, it directed Shad Nagar municipal authorities to immediately pull down the wall and provide facilities for commuting on the road.
HC Bench comprising chief justice Ujjal Bhuyan, justice N Tukaramji gave its decision in this regard quashing a petition filed by Sri Sai Balaji Township Welfare Society. The developer of the township, developed a DTCP layout in 83 acres in Solipur village of Farooq Nagar mandal of Shadnagar municipality. The developer raised a wall blocking the road leading to other layouts. The locals and people living in other layouts moved the court. A single judge going through the records got confirmed that the developer did not obtain the requisite permission to develop the layout.
The developer assured the court to pull down the wall once the gated community is fully executed. But, he did not fulfil his promise made to the court. The officials noted that the builder has encroached road up to acres of area and initiated legal proceedings against the builder. The land owners who parted their land for the real estate project alleged that the builder had duped them and moved the high court to close down the road to protect their interests. However, the HC quashed the petition that it is not proper to close the road that is beneficial to the people and directed municipal authorities to pull down the wall and open the road for commuting.
