The Telangana High Court found fault with the HMDA for not taking any action against the Ramky in enforcing the agreement reached with Ramky. Under survey numbers 227 and 230 in Srinagar of Maheshwaram mandal of Rangareddy district, the HMDA in association with Ramky is building realty projects titled Gardenia, Grove Village, Green View, Huddle, Golden Circle developing flats and villas. The court faulted the HMDA for not serving notice on Ramky and cancelling the agreement as the latter defaulted payment of Rs 75 crore to the HMDA. The court held that sub-registrars cannot suspend registration of flats and villas on the basis of the HMDA letter. When the Ramky challenged the HMDA notice, the HMDA did not appraise the court the measures taken by the HMDA like arbitration and other legal measures.
Sub-registrars refused to register the Ramky and HMDA projects undertaken in Srinagar citing that the said land is included among the prohibited lands. Challenging it, Ramky and others moved petition in HC. HMDA counsel told the court that Ramky is supposed to pay Rs 100 crore to the HMDA but it paid only Rs 25 crore. But the judge observed that the HMDA did not implement any measures it is supposed to take against Ramky as per the law in case of violation by the Ramky. The judge remarked that no justification has been found in suspending registration. On the basis of letter received from the HMDA, the sub-registrars were asked not to suspend registration of the properties.
