RERA has recently clarified that collecting maintenance charges in advance of a period of one or two years is against the rules. The authorities concerned have been directed to restrain the promoters from collecting advance maintenance charges. Further, it has stated that co-operative housing societies should be formed only after at least half of the flats are sold. Mumbai Grahak Panchayat Chairman Shirish Desh Pandey said that collecting maintenance charges at once, for a period of one or two years is against the RERA Act and Maharashtra RERA has issued several guidelines in this regard. It is said to be very beneficial for home buyers. “According to Section 11 (4) (e) of the RERA Act, provisions 9(1) of the Maharashtra RERA, the promoter has to take steps to form the residents welfare association within three months after the majority of the flats in an apartment are booked. Otherwise, there is no reason for the promoter to collect maintenance charges,” he explained. It has been clarified that charging advance maintenance charges is completely illegal.
