  • Bombay HC warns a builder who disobeyed SC stay orders

The Bombay High Court breathed fire on a builder who disregarded even a stay order issued by the Supreme Court. The court sought to know from the builder whether the same fate should fall on his project as that of the Noida twin towers, which were razed to the ground recently. In suburban Mumbai, a builder took up construction of a structure illegally at Khar. But, the SC issued a stay order on the structure in 1995. Recently, the builder decided to resume the construction of the project. A PIL has been filed in the Bombay High court on it.

Responding to the PIL, a HC bench comprising Justice Deepankar Datta and Justice MS Karnik took up the trial on it and asked an architect to report the bench the actual situation at the ground level. The architect reported the post-SC stay order developments at the work site. But, the counsel for the builder argued before the bench that the stay should have to be vacated since the objections raised on the site have been cleared. Refusing to buy the argument, the HC bench said, “Let us adopt a wait-and-watch attitude on this.” It commented that the builder is perhaps seeking to step into the shoes of the Super Tech Builders. It posted further hearing on the PIL to a later date.
