Builder ordered to pay double amount

Deciding a cheque bounce case, court directed a builder to pay double the amount to customers as a punishment for cheques given by the builder to customers were not honoured by banks. Two persons belonging to Mumbai identified as Anuj Kumar Jha and Pankaj Kumar booked two flats with Parisha Developers Limited in 2014. Anuj Kumar booked 503 sft, costing Rs 54 lakh, but paid Rs 16 lakh, while his brother Pankaj Kumar Jha booked 665 sft flat costing Rs 80 lakh, but paid Rs 25 lakh towards the initial amount. As per the agreement, the builder is supposed to hand over the flats in 2016. But the builder failed to hand them over as per the due date. As a result, the agreement became null and void.  But the builder failed to return Rs 41 lakh paid by Jha brothers. The cheques given by the builder to them were bounced. The Jha brothers moved court. Hearing both sides, the court directed the builder to pay Rs 82 lakh since the cheques given to the Jha brothers were bounced.
