Telangana state disputes’ redressal commission has ordered Aliens Developers to refund the money to 10 people after the company failed to deliver the property after collecting money. The real-estate firm was also told to pay Rs 50,000 as compensation for mental agony caused to the aggrieved. In the case of Harinath Appani, one of the complainants, he had purchased a flat with a built up area of 2150 square feet for a sale consideration of Rs 54 lakh.
As on 2008, he had paid Rs 20 lakh, after Alien promised to complete the construction of the flat March 2010 including the grace period or else agreed to pay compensation of Rs 3 per square feet if it fails to complete the project.
Harinath and nine others approached the commission as the developer failed to hand over the flat within the stipulated timeframe. Aliens argued that the complainant never asked for a refund of money or for cancellation of the agreement. The firm also said that the complainant didn’t pay installments and claimed that ‘force majeure’ like delay in permissions from fire service and other agencies has led to delay in the project.
The forum observed, “Aliens Developers engaged in the construction have to know all aspects and requirements of permission before starting the collection of amounts from the flat owners.” Aliens was ordered to refund Rs 48 lakh and further directed to pay 9 per cent interest on principal amount of Rs 20 lakh from 2018. Alien was also asked to pay Rs 10,000 towards legal expenses.
