No Escape for Builders: RERA Fines Sunrise Abode ₹5 Lakh, Orders Possession

The Telangana Real Estate Regulatory Authority (TG RERA) has directed the promoters of the project Sunrise Abode at Ramachandrapuram, Sangareddy district, to handover Flat No. 411 to the complainant within 30 days and imposed a penalty of ₹5 lakh for statutory violations.

The Complaint
The buyer booked Flat No. 411, Block C, admeasuring 1500 sq. ft. with parking, under an Agreement of Sale dated October 2022. A revised agreement was executed in March 2024, fixing the sale consideration at ₹67.25 lakh. The complainant claims to have paid nearly ₹55 lakh, including amounts for registration and loan charges. Despite this, the promoters failed to register the flat or hand over possession and allegedly demanded additional sums, including an unwarranted ₹1.5 lakh interest, paid under pressure.

Authority’s Findings
Payments were routed through multiple personal accounts of partners, associates, and employees instead of the designated RERA project account, a direct breach of Section 4(2)(l)(D) of the Real Estate Act. The defence of “internal partner disputes” was rejected. The Authority noted that 80–90% of flats were already occupied since January 2024, even without an occupancy certificate. The promoters’ claim that registration required 53% shareholder consent was dismissed as legally baseless.

Key Orders
Promoters must execute and register the sale deed in favour of the buyer within 30 days, after receiving the balance amount. A ₹5 lakh fine was imposed on Respondents No. 1, 2, and 3, who are held jointly and severally liable. All future collections must be deposited only into the designated project bank account. Any deviation could lead to the promoters being declared defaulters. Buyers were cautioned not to transfer money into personal accounts of promoters or their staff. This ruling reinforces that RERA protects homebuyers and that promoters cannot cite internal disputes or excuses to deny possession once payments are made.
