In a significant interim relief to a homebuyer, the competent Authority has restrained two respondents from alienating or creating any third-party rights over a disputed villa plot in Sangareddy district, pending final adjudication of a complaint.
The interim order pertains to Plot No. 63 (Schedule ‘D’ Property), forming part of a villa development originally marketed under the project name DHRITI NIRVANA, located at Hothi-B Village in Zaheerabad Mandal of Sangareddy District. The Authority noted that the complainant had established a substantial and prima facie interest in the said property.
As per the record, the complainant entered into an Agreement to Sell on July 9, 2021, with Respondent No.1 for a fully constructed villa proposed on Plot No. 63, for a total consideration of ₹50 lakh. The Authority observed that the complainant had paid ₹40 lakh between July and November 2021, followed by an additional ₹5 lakh on May 24, 2022, after receiving assurances regarding priority completion and extension of time. In total, ₹45 lakh—representing 90% of the agreed sale consideration—was paid by the complainant.
The complaint further alleges that the earlier Development Agreement-cum-Irrevocable General Power of Attorney dated March 8, 2021, was unilaterally cancelled, and that fresh Development Agreements dated May 18, 2024, along with a new Irrevocable General Power of Attorney dated August 31, 2024, were executed in favour of Respondent No.6 for the very same property. The Authority took note of the complainant’s apprehension that the subject property could be imminently alienated.
After examining the material on record, the Authority held that, to protect and preserve the complainant’s claimed rights and to prevent the proceedings from being rendered infructuous, an interim restraint was warranted. Accordingly, Respondent Nos. 4 and 6, along with their agents, representatives, assignees, or any person claiming through them, have been restrained from creating any third-party rights, title, interest, charge, lien, mortgage, lease, or encumbrance of any kind over Plot No. 63.
The Schedule ‘D’ property admeasures 763.53 square yards (Ac. 0-6.30 guntas) and forms part of a larger extent of land carved out in multiple survey numbers at Hothi-B Village. The plot is bounded by Plot No. 105 to the north, Plot No. 62 to the south, a 33-feet-wide road to the east, and Plot No. 94 to the west.
The interim order will remain in force until further directions. The matter has been posted for further hearing on March 17, 2026.
